Welcome to RealScroll.

These Terms of Service govern your access to and use of the RealScroll website, mobile applications, software, features, content analysis systems, and related services we provide through the platform. By creating an account, accessing, or using RealScroll, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use RealScroll.

ARBITRATION NOTICE: EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED BELOW, YOU AND REALSCROLL AGREE THAT DISPUTES WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS WIDE PROCEEDING.

1. The RealScroll Service

RealScroll is a social media platform designed to support authenticity, transparency, and community engagement in online content. The service includes the website, mobile applications, creator tools, profile features, media upload systems, moderation systems, AI detection systems, visibility systems, subscription features, and all related technologies and functionality we make available.

The RealScroll service includes, among other things:

1. Allowing users to create accounts, upload content, engage with others, and participate in a social media platform built around real user generated content.

2. Using content moderation tools, automated systems, and related review processes to help detect spam, abuse, explicit material, manipulated media, synthetic media, and other policy concerns.

3. Using media analysis systems and third party technologies to provide informational indicators relating to the possible authenticity or manipulation of uploaded content.

4. Operating recommendation, feed, ranking, visibility, reach, and discovery systems that determine how content appears, performs, and is distributed throughout the platform.

5. Offering paid subscriptions, account upgrades, creator features, and additional tools through services such as RealScroll Pro.

6. Maintaining platform safety, integrity, and performance through internal systems, moderation actions, and security measures.

RealScroll may improve, modify, suspend, limit, or discontinue any part of the service at any time.

2. Eligibility and Account Registration

You must be at least 13 years old to use RealScroll. By using the platform, you represent and warrant that you meet the minimum age requirement and have the legal capacity to enter into these Terms.

You agree to provide accurate, current, and complete information when creating an account and to keep that information updated.

You may not create an account if:

1. You are prohibited from using the service under applicable law.

2. Your account has previously been suspended or terminated by RealScroll for violating these Terms or other platform policies.

3. You are using the platform for unlawful, deceptive, abusive, or unauthorized purposes.

We reserve the right to verify account information, request additional information, suspend access, or terminate accounts that do not satisfy eligibility requirements.

3. Your Account and Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree that you will not:

1. Share your login credentials with others.

2. Impersonate any person, brand, business, or entity.

3. Create accounts using false or misleading identity information.

4. Transfer, sell, rent, or assign your account, username, or access rights without our written consent.

5. Use another user’s account without authorization.

If you believe your account has been accessed without authorization, you must notify us promptly.

4. User Content and Ownership

Users retain ownership of the content they create and upload to RealScroll, including photos, videos, text, captions, comments, profile materials, and other user generated content.

However, by posting, uploading, or sharing content through the platform, you grant RealScroll a worldwide, non exclusive, royalty free, transferable, sublicensable license to host, store, reproduce, format, process, adapt, modify for technical display purposes, distribute, display, perform, publish, promote, and make available that content in connection with operating, improving, marketing, and providing the RealScroll service.

This license allows us to do things such as:

1. Display your content in feeds, profiles, search results, discovery areas, and recommendation systems.

2. Process your content for moderation, detection, safety, technical optimization, compression, resizing, and platform functionality.

3. Use your content in connection with platform promotion, service development, product improvement, and user experience functions, subject to your settings and applicable law.

This license ends within a commercially reasonable period after your content is deleted from our active systems, except to the extent content has been retained for legal, safety, security, backup, enforcement, or technical reasons.

RealScroll does not claim ownership of your content.

5. Your Responsibility for Content

You are solely responsible for the content you upload, post, transmit, share, or otherwise make available on RealScroll.

By submitting content, you represent and warrant that:

1. You own the content or have all rights, permissions, licenses, and authority necessary to post and share it.

2. Your content does not violate any law, contract, intellectual property right, privacy right, publicity right, or other right of any third party.

3. Your content does not contain unlawful, fraudulent, misleading, malicious, infringing, or unauthorized material.

4. You understand that RealScroll does not pre review, verify, or approve every item of content before it appears on the platform.

RealScroll does not review or pre screen all user generated content for copyright compliance, legal compliance, truthfulness, or authenticity. Users, not RealScroll, are responsible for ensuring that their content is lawful and properly authorized.

6. Platform Role and User Generated Content

RealScroll provides a platform that allows users to create, upload, distribute, and view content created by others.

RealScroll does not create, author, adopt, endorse, guarantee, or assume responsibility for user generated content. Content posted by users represents the views, statements, and responsibility of the users who posted it.

You acknowledge and agree that:

1. You may encounter content that is inaccurate, manipulated, misleading, explicit, disturbing, offensive, or otherwise objectionable.

2. RealScroll is not responsible for user content or for any loss, harm, reputational damage, emotional distress, or other consequences resulting from exposure to or reliance on user content.

3. RealScroll acts as a platform provider and reserves the right, but not the obligation, to review, moderate, remove, label, blur, restrict, or limit content in its discretion.

7. AI Detection, Media Analysis, and Informational Indicators

RealScroll may analyze uploaded photos, videos, and other media using automated systems, machine learning tools, and third party technologies intended to identify potential indicators of synthetic media, manipulation, pixel level anomalies, deepfake characteristics, or other authenticity related signals.

These systems may include services provided by third parties such as Sightengine or similar vendors.

You acknowledge and agree that:

1. Detection systems are informational tools only.

2. Detection outputs are probabilistic and may not always be accurate, complete, or reliable.

3. Detection results should not be interpreted as conclusive statements regarding authenticity, origin, authorship, ownership, manipulation, or legality.

4. RealScroll does not guarantee the accuracy or reliability of any AI detection result, moderation label, authenticity indicator, or informational notice.

5. RealScroll may use automated analysis together with human moderation, policy review, or additional safety processes.

RealScroll shall not be liable for any decisions, actions, damages, disputes, or conclusions resulting from the use of or reliance upon AI detection results or media analysis outputs.

8. Content Moderation, Sensitive Content, and Enforcement

To maintain platform integrity and user safety, RealScroll may use automated tools, internal review systems, human moderators, and third party services to detect, review, label, blur, restrict, deprioritize, remove, or otherwise moderate content and accounts.

This may include content relating to:

1. Spam or abuse.

2. Manipulated or synthetic media.

3. Graphic or explicit content.

4. Misleading or deceptive content.

5. Illegal or harmful material.

6. Policy violations or platform misuse.

RealScroll may apply warnings, visibility limits, blur screens, explicit content labels, restricted states, or removal actions where appropriate.

Some moderation decisions may be based on automated systems. Some may involve human judgment. Moderation outcomes may not always be perfect, and RealScroll is not liable for moderation errors, delays, disagreements, or perceived inconsistencies.

9. Content Visibility, Ranking, Reach, and Distribution

RealScroll uses internal systems to determine how content is displayed, surfaced, ranked, rotated, recommended, distributed, deprioritized, or withheld across the platform.

These systems may consider factors such as:

1. User activity and engagement.

2. Community interest and interaction velocity.

3. Moderation signals and safety systems.

4. Content quality, account standing, and authenticity related indicators.

5. Spam prevention and platform integrity measures.

6. Paid features, creator tools, and subscription status, where applicable.

RealScroll may also use internal momentum, trend, or discovery systems that surface posts based on performance signals. These systems may identify content as getting noticed, trending post, going viral, or similar status indicators for informational and distribution purposes.

You acknowledge and agree that:

1. RealScroll does not guarantee any particular level of impressions, reach, engagement, audience growth, distribution, discoverability, or performance.

2. Content may be limited, deprioritized, hidden, or shown to fewer users without notice.

3. Platform logic, feed logic, and recommendation systems may change at any time.

4. Perceived declines in visibility or growth do not create liability for RealScroll.

10. Posting Limits and Fair Use of Platform Resources

To help prevent spam, maintain system performance, and manage the operational costs associated with content moderation, API based scanning, and media analysis, RealScroll may apply posting limits based on account type.

Free accounts are limited to 50 image or video posts per day.

Once that daily limit is reached, additional image or video posts may not be published until the next posting cycle resets.

RealScroll Pro accounts may receive unlimited image and video posting privileges, subject to platform rules, moderation systems, and acceptable use standards.

RealScroll may update or adjust posting limits at any time to protect platform stability, integrity, cost management, and fair use of platform resources.

11. RealScroll Pro and Paid Features

RealScroll may offer optional paid subscriptions, premium account types, or upgraded features, including RealScroll Pro.

A Pro subscription may include access to features such as:

1. Pro badges or profile identifiers.

2. Advanced creator profile functionality.

3. Clickable links and expanded profile tools.

4. Priority or enhanced access to certain platform features.

5. Unlimited media posting.

6. Other premium features that may be introduced, changed, or removed over time.

By purchasing a paid subscription, you agree to pay all applicable fees and authorize RealScroll or its payment provider to charge your selected payment method.

Subscriptions may renew automatically unless cancelled before the renewal date. Unless required by law, payments are non refundable once processed.

RealScroll may modify pricing, billing periods, feature sets, or plan structure at any time. Continued use of a paid subscription after a change becomes effective constitutes acceptance of the updated pricing or features.

RealScroll does not guarantee that any paid feature or Pro status will result in increased visibility, more followers, increased engagement, business success, credibility, or income.

12. Acceptable Use Restrictions

You agree not to do any of the following:

1. Use RealScroll for unlawful, fraudulent, deceptive, or unauthorized purposes.

2. Post infringing, illegal, defamatory, harassing, hateful, violent, exploitative, or otherwise prohibited content.

3. Use bots, scripts, scrapers, crawlers, or automated tools to access, extract, collect, or manipulate platform data without our written permission.

4. Attempt to reverse engineer, decompile, interfere with, damage, or compromise the service or its infrastructure.

5. Circumvent posting limits, moderation systems, security controls, or visibility restrictions.

6. Manipulate engagement, trend systems, discovery logic, or ranking systems.

7. Buy, sell, transfer, lease, or commercially exploit accounts, usernames, badges, or access credentials.

8. Upload malicious code, viruses, or harmful software.

9. Abuse reporting, appeals, moderation, customer support, or enforcement channels.

10. Interfere with another user’s use of the platform.

We may investigate violations and take any enforcement action we deem appropriate.

13. Intellectual Property and Copyright

RealScroll respects the intellectual property rights of others and expects users to do the same.

Users may only upload content they own or have the legal right to use. This includes music, audio tracks, videos, images, artwork, graphics, and other copyright protected material.

RealScroll does not review or pre screen all user generated content for copyright compliance. Users are solely responsible for ensuring that the content they upload does not infringe any copyright, trademark, or other intellectual property rights.

If you believe content on RealScroll infringes your rights, you may contact:

RealScroll may remove, disable, restrict, or investigate allegedly infringing content and may suspend or terminate repeat infringers.

14. Music and Audio Content

If you upload content containing music, sound recordings, audio clips, or other audio material, you represent and warrant that you have all necessary rights, licenses, permissions, and authorizations to use and distribute that audio on the platform.

RealScroll does not grant users a license to use copyrighted music unless expressly stated otherwise. The use of music or audio in uploaded content is the sole responsibility of the user.

RealScroll is not responsible for unauthorized music uploads made by users.

15. Username, Brand, and Platform Rights

RealScroll reserves all rights not expressly granted to you under these Terms.

You may not use RealScroll’s name, trademarks, logos, branding, designs, software, interface elements, or other proprietary materials except as expressly permitted by us in writing.

We may reclaim, modify, or remove usernames, handles, profile identifiers, badges, or account designations if we determine that doing so is appropriate, necessary, or consistent with our rights, policies, legal obligations, or platform integrity.

16. Third Party Services and Integrations

RealScroll may use or integrate third party services for hosting, payments, analytics, communications, moderation, scanning, AI analysis, authentication, and other business or technical functions.

We are not responsible for the content, security, availability, terms, privacy practices, or conduct of third party services. Your use of those services may also be subject to separate terms and policies.

17. Privacy and Data Use

Your use of RealScroll is also subject to our Privacy Policy, which explains how we collect, use, store, share, and process personal information.

By using RealScroll, you acknowledge that we may collect and process information necessary to operate the platform, maintain security, provide support, enforce policies, improve the service, and perform media analysis and moderation functions.

18. Service Availability and Changes

We do not guarantee that RealScroll will always be available, secure, uninterrupted, or error free.

The platform may experience outages, delays, interruptions, bugs, or changes caused by maintenance, system updates, third party failures, technical problems, abuse prevention measures, or other reasons.

RealScroll may modify, suspend, or discontinue any part of the service at any time without liability.

19. Suspension, Restriction, and Termination

RealScroll may suspend, restrict, disable, remove, or terminate your account or access to the platform at any time, with or without notice, if we believe you have violated these Terms, our policies, applicable law, or if your conduct creates risk, exposure, abuse, disruption, or harm to the platform, its users, or others.

We may also remove content, reduce visibility, revoke premium status, disable monetization related features, remove badges, restrict distribution, or take other enforcement action in our discretion.

You may stop using RealScroll at any time. If you delete your account, some data may remain in backups, logs, archived systems, legal retention systems, or safety records for a reasonable period as required for operational, technical, legal, or security purposes.

20. Feedback and Suggestions

If you provide suggestions, ideas, feedback, recommendations, or other input regarding RealScroll, you agree that we may use that feedback without restriction, attribution, compensation, or obligation to you.

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALSCROLL PROVIDES THE SERVICE ON AN AS IS AND AS AVAILABLE BASIS.

REALSCROLL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON INFRINGEMENT, AVAILABILITY, ACCURACY, RELIABILITY, SECURITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE, COMPLETELY SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT, ANALYSIS RESULTS, OR PLATFORM OUTPUTS WILL BE ACCURATE OR RELIABLE.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALSCROLL, ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR LOST PROFIT DAMAGES, OR FOR ANY LOSS OF DATA, REPUTATION, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO:

1. YOUR USE OF OR INABILITY TO USE THE SERVICE.

2. USER GENERATED CONTENT OR THIRD PARTY CONTENT.

3. CONTENT MODERATION ACTIONS OR FAILURES TO TAKE ACTION.

4. AI DETECTION RESULTS, LABELS, WARNINGS, OR ANALYSIS OUTPUTS.

5. VISIBILITY, REACH, ENGAGEMENT, RANKING, OR CONTENT DISTRIBUTION DECISIONS.

6. ACCOUNT SUSPENSION, TERMINATION, OR FEATURE RESTRICTION.

7. THIRD PARTY SERVICES OR PROVIDERS.

8. UNAUTHORIZED ACCESS, DATA LOSS, OR SECURITY INCIDENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALSCROLL’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS OR THE AMOUNT YOU PAID TO REALSCROLL IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

23. Indemnification

You agree to defend, indemnify, and hold harmless RealScroll, its affiliates, owners, officers, directors, employees, contractors, licensors, and agents from and against any claims, actions, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

1. Your content.

2. Your use of the service.

3. Your violation of these Terms or any law.

4. Your infringement of any intellectual property, privacy, publicity, or other rights.

5. Any dispute between you and another user or third party.

24. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

You and RealScroll agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved through binding individual arbitration, except for claims that qualify for small claims court and claims relating to intellectual property, unauthorized access, misuse of the platform, injunctive relief, or other claims that by law cannot be arbitrated.

You and RealScroll agree to waive any right to a jury trial and any right to participate in a class action, collective action, representative action, or class wide arbitration.

Before initiating arbitration, the party seeking relief must first send written notice of the dispute and allow thirty days for informal resolution.

If the dispute is not resolved informally, arbitration will be conducted on an individual basis under the applicable consumer arbitration rules of the American Arbitration Association, unless another administrator is required by law or agreed by the parties.

This arbitration provision is governed by the Federal Arbitration Act.

If any part of this arbitration section is found unenforceable, the remaining portions will remain in effect to the fullest extent permitted by law.

25. Governing Law and Venue

These Terms and any dispute not subject to arbitration shall be governed by the laws of the State of Tennessee, without regard to conflict of law principles.

Subject to the arbitration provisions above, any action that is permitted to proceed in court shall be brought exclusively in the state or federal courts located in Tennessee, and you consent to the personal jurisdiction and venue of those courts.

26. Assignment and Transfer

You may not assign, transfer, delegate, or sublicense any rights or obligations under these Terms without our prior written consent.

RealScroll may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, sale of assets, corporate reorganization, or by operation of law.

27. Severability

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.

28. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

29. Entire Agreement

These Terms, together with any policies and supplemental terms that expressly apply, constitute the complete agreement between you and RealScroll regarding the service and supersede any prior agreements or understandings relating to the subject matter.

30. Updates to These Terms

We may update these Terms from time to time to reflect changes to the platform, the law, our practices, or our services.

If we make material changes, we may provide notice through the platform, by email, or by other reasonable means. Your continued use of RealScroll after updated Terms become effective means you accept the revised Terms.
